Monsanto Technology Agreement for 2002

The first agreement is printed on the seed purchase invoice.  The second agreement is attached to the seed purchase invoice in those situations when the retailer cannot print on the actual invoice.

This Roundup Ready (TM) soybean seed includes a limited license under U.S. Patents 4,940,835; 5,188,642; 5,352,605; 5,633,435; 5,530,196; 5,717,084; 5,728,925; and 5,804,425 for planting of a commercial crop. 

The Grower agrees to pay _______ (seed seller), acting as agent for Monsanto, a Technology Fee to be determined by Monsanto. 

The Grower agrees not to supply any of this seed to anyone for planting and agrees not to save any crop produced from this seed for replanting or supply saved seed to anyone for replanting.

The Grower agrees not to use this seed or provide it to anyone for crop breeding, research or seed production.

If you use a herbicide over the top of a Roundup Ready (TM) crop that is not selective to the same crop without the Roundup Ready (TM) gene, you agree to use only Roundup (R) brand herbicide or a herbicide brand expressly authorized by Monsanto as specified in Monsanto's Technology User Guide .

Use of any selective herbicide labeled for the same crop without the Roundup Ready gene is not restricted by this agreement.

MONSANTO DOES NOT WARRANT THE CROP SAFETY OR PERFORMANCE OF HERBICIDES OTHER THAN MONSANTO BRANDS.

This Roundup Ready (R) soybean seed includes a limited license under U.S. Patents 4,940,835; 5,188,642; 5,352,605; 5,633,435; 5,530,196; 5,717,084; 5,728,925; and 5,804,425 for planting a single commercial crop.

Monsanto retains ownership of the licensed genes (for example, the Roundup Ready gene), and the gene technologies, and the Purchaser receives the right to use the licensed genes and technologies.

The Purchaser agrees as follows: 

1. To use the seed containing Monsanto gene technologies solely for planting a single commercial crop;
2. Not to supply any of this seed to any other person or entity for planting, and not to save any crop produced from this seed for replanting, or supply seed produced from this seed to anyone for replanting;
3. Neither to use this seed nor to provide it to anyone else to use for crop breeding, research, generation of herbicide registration data, or seed production;
4. To use in Roundup Ready crops only a Roundup brand or other herbicide which has been approved for use and received a label for use in the particular Roundup Ready crop by all required governmental agencies;
5. To acquire seed containing these gene technologies only from a seed company with required technology license(s) from Monsanto and to pay the applicable Technology Fee for the particular product being purchased;

*MONSANTO DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR RECOMMENDATIONS CONCERNING THE USE OF PRODUCTS MANUFACTURED OR MARKETED BY OTHER COMPANIES WHICH ARE LABELED FOR USE IN ROUNDUP READY CROP(S).

*MONSANTO SPECIFICALLY DISCLAIMS ALL RESPONSIBILITY FOR THE USE OF THESE PRODUCTS IN ROUNDUP READY CROP(S).

This limited license only covers the United States, and does not authorize planting of seed in the United States which has been acquired in another country or planting of seed in another country which has been acquired in the United States.

ALL QUESTIONS AND COMPLAINTS ARISING FROM THE USE OF PRODUCTS MANUFACTURED OR MARKETED BY OTHER COMPANIES SHOULD BE DIRECTED TO THAT COMPANY.
